Habitability Violations and Failure to Repair
California law requires landlords to repair and maintain rental units so that they are safe and fit for tenants to live in, commonly known as the “Warranty of Habitability.” This means that landlords are legally required to repair conditions that seriously affect the tenants’ living conditions. Specifically, landlords must repair significant defects in the rental unit that are in violation of state, and local building and health codes.
Specifically, your rental unit must have the following:
- Roofs, walls, doors and windows in good condition (including, proper waterproofing and weather protection)
- Floors, stairs and railings in good condition
- Plumbing facilities in good working condition
- Hot & cold water access
- Sewage disposal system
- Functioning toilet, sink & shower/bathtub
- Heating system in good working condition
- Gas facilities in good working condition
- Electricity facilities in good working condition (including, lighting and wiring)
- Property free of pest infestations (including, insects, bed bugs, rodents and vermin)
- Working smoke detectors
- Working lock on main entry door and locking windows
- Garbage receptacles available and in good condition
- Clean, sanitary and well-lit building and common areas
